Monday, March 1st, 2010 | Author By AdminIn the United States, laws and especially criminal legalities are different in different states. Lets have a short look when it comes to Assault crimes in California.
California criminal attorneys normally have a very high charge, but they are also very good at what they do. An individual accused of assault is charged under Penal Code 242 in california. Just because the person is charged doesn’t mean that he/she will be convicted of the crime. The charge can be dropped in several cases like -
Self-Defense: If the lawyers can provde the accused committed violation in self-defense the charges can be revoked or reduced.
Accidental: Provided the lawyers of the accused can provide that he/she accidentally hurt the victim and the crime was not intentional. The person who is accused will need a very competent lawyer in order to prove that it was accidental and it was infact an accident.
Consent: This mainly comes in sport, where in a contact game the player willing participates in the match and is aware that he/she could get badly injured in such circumstances.
